Terms of Service

These Terms of Service (“Terms”) govern your use of Newwebsite.ai (the “Service”), operated by Newwebsite Inc. (“Newwebsite,” “we,” or “us”). By creating an account, generating a site, or otherwise using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. The Service

Newwebsite.ai is an AI-assisted website builder that lets you generate, edit, host, and optionally publish websites. Some features are free; others require a paid subscription. We may add, change, or remove features at any time.

2. Your account

  • You must provide accurate registration info and keep it updated.
  • You’re responsible for safeguarding your account and for all activity under it. Notify us immediately at support@newwebsite.ai if you suspect unauthorized access.
  • You must be at least 13 (16 in some regions) to use the Service.

3. Your content

Anything you upload, paste, generate, or save through the Service (your “Content”) remains yours. You grant Newwebsite a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display your Content solely to provide the Service to you (e.g. rendering your published site, processing edits, generating screenshots).

You represent and warrant that you have the rights to all Content you submit, and that none of your Content infringes third-party rights or violates applicable law.

4. AI features

The Service uses third-party AI providers (currently Anthropic and Google) to generate content based on your prompts. AI output is probabilistic and may contain errors, biases, or inaccuracies. You’re responsible for reviewing AI-generated content before publishing it. Newwebsite makes no warranty that AI output will be accurate, fit for any specific purpose, or free of third-party rights.

5. Acceptable use

You agree not to:

  • Use the Service to generate, host, or publish illegal, harmful, harassing, or deceptive content; child sexual material; non-consensual intimate imagery; or content that promotes violence or hatred.
  • Reverse engineer, scrape, or otherwise extract data or models from the Service except as expressly permitted.
  • Probe, attack, or interfere with the security or integrity of the Service.
  • Use the Service to spam, phish, or distribute malware.
  • Resell or sublicense access to the Service without our prior written consent.
  • Upload content that infringes a third party’s intellectual property or privacy rights.

We may suspend or terminate accounts that violate these rules.

6. Plans, billing, and refunds

Paid plans are billed in advance on the cadence shown at checkout. Subscriptions auto-renew until cancelled. You can cancel any time from the dashboard; cancellation takes effect at the end of the current billing cycle.

Prices may change with at least 30 days’ notice for existing subscribers. Refunds are at our discretion except where required by law.

7. Intellectual property

The Service itself — including the editor, our prompts, libraries, code, design assets, and brand — is owned by Newwebsite or its licensors and protected by copyright, trademark, and other laws. We grant you a limited, non-transferable license to use the Service for its intended purpose. No other rights are implied.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if continuing to provide the Service to you would create undue risk. On termination, your right to use the Service ends; we may delete your Content after the retention window described in our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWWEBSITE DISCLAIMS ALL WARRANTIES — EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWWEBSITE’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) US$100. IN NO EVENT WILL NEWWEBSITE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, OR DATA.

11. Indemnity

You agree to defend and indemnify Newwebsite from any claim arising out of (a) your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your infringement of any third party’s rights.

12. Governing law

These Terms are governed by the laws of the State of Delaware (without regard to conflict-of-laws rules). The exclusive venue for disputes is the state and federal courts located in Delaware, and you consent to personal jurisdiction there.

13. Changes

We may update these Terms from time to time. Material changes will be flagged in-app or by email. Continued use of the Service after the effective date of an update constitutes acceptance.
